- All prices are in INR and exclude applicable taxes, tariffs, duties and shipping fees.
Force Majeure
Neither party shall be held liable for any failure to perform or delays in the performance of any obligation under this agreement due to events beyond their reasonable control. Such events shall
include, but are not limited to:
- Natural disasters (earthquakes, floods, hurricanes, etc.)
- Acts of war, terrorism, or civil unrest
- Strikes, lockouts, or labor disputes
- Government actions or regulations, including changes in laws, taxes, tariffs, duties, etc
- Pandemics, epidemics, or other public health emergencies
- Supply chain disruptions, shipping delays, or transportation blockages
- Fire, explosion, or other catastrophic events
Notification of Force Majeure: The affected party must notify the other party in writing as soon as reasonably possible, providing full details of the force majeure event and its expected duration. The party invoking force majeure will also provide reasonable evidence to support the claim of the event.
Suspension of Obligations: Upon occurrence of a force majeure event, the affected party will be excused from performance of their obligations under this agreement for the duration of the force majeure event. This may include delays in product delivery, suspension of services, or failure to meet agreed deadlines.
Duration of Force Majeure: If the force majeure event continues for more than 90 days, either party may have the right to terminate this agreement without penalty by providing written notice to the other
party.
Mitigation Efforts: The affected party must take all reasonable steps to mitigate the impact of the force majeure event, including seeking alternative solutions or methods of performance where
possible.
Orders and Payment
- By placing an order with us, you offer to purchase the products subject to these Terms and Conditions.
- We accept payment via credit card, check, ACH and Wire. •
- Orders are subject to our acceptance. We reserve the right to refuse any order for reasons including but not limited to product unavailability, fraud prevention, or legal concerns.
Shipping and Delivery
- Atex Sierra. will ship products to the address specified by the customer during the checkout process or on the customer’s purchase order.
- Shipping times and fees will be specified during checkout. We are not responsible for delays caused by the manufacturer, third-party carriers or unforeseen circumstances.
- Risk of loss and title for the products are passed to you upon delivery to the carrier.
Warranty and Returns
- Our products come with a warranty determined by the manufacturer. Contact us or refer to the product page for specific information.
- Returns are accepted within 30 days of purchase, provided the product is in its original condition and packaging. Shipping costs and restocking fees for returns are the responsibility of the customer unless the return is due to a defect or error by Atex Sierra.
- Products that are opened, used, or damaged by the customer are not eligible for return or refund.
